Professional Negligence
For many years Nigel Pepper has been a member of the Law Society Negligence Panel. In this role the Law Society has referred clients of other solicitors to him for advice as to whether or not they have been the victims of professional negligence by their solicitors.
Nigel Pepper is also a member of the Professional Negligence Lawyers Association, an Association which pools resources and seeks to grow the expertise of its members in this field.
Examples of cases in which we have been involved are the following:
- Obtaining compensation for the Estate of a miner who contracted lung disease from his exposure to coal dust where the solicitor who had been instructed failed to meet time limits and the right to claim compensation from the Coal Board was accordingly lost. In this case we worked closely with Pannone & Co who were able to provide expert advice as to the compensation which would have been obtained but for the default of the solicitor who had been instructed to handle the case.
- A claim against an insurance broker who, it is alleged, failed to advise upon the meaning and effect of the terms of a policy so that the insurer avoided liability to make a payment for non-compliance with the terms of the policy after the event giving rise to the claim had occurred.
