Nigel Pepper, consultant at Hand Morgan & Owen solicitors, highlights two cases in the employment field which catch the eye as being slightly quirky. The first involved a female employee who was taking an unauthorised break being confronted in the female toilets by a male manager. He shouted at her. She complained of sex discrimination. The Employment Appeal Tribunal found, however, that a female manager of a male employee at this particular company would have acted similarly towards that male employee in the male toilets and therefore there was no discrimination. In the second an atheist teacher applied for a teaching post at a Roman Catholic School. That teacher was not considered because of his atheism. Notwithstanding the fact that the education was centred upon religious belief the applicant was found to have been unlawfully discriminated against by reason of religion.
